The relation between method, concept and theory in science is complicated. I seek to shed light on that relation by considering an instance of it in systematics: The additional challenges phylogeneticists face when reconstructing phylogeny not at a single level, but simultaneously at multiple levels of the hierarchy. How does this complicate the task of phylogenetic inference, and how might it inform and shape the conceptual foundations of phylogenetics? This offers a lens through which the interplay of method, theory and (...) concepts may be understood in systematics, which, in turn, provides data for a more general account. (shrink)

Michael Ghiselin and David Hull’s individuality thesis is that biological species are individuals. Philosophers often treat the term “individual” as synonymous with “mereological sum” and characterize it in terms of mereology. It is easy to see how the biological project has been interpreted as a mereological one. This chapter argues that this is a mistake, that biological part/whole relations often violate the axioms of mereology. Conflating these projects confuses the central issues at stake in both, and makes the job of (...) evaluating either unnecessarily burdensome. Clarifying this helps identify the genuine metaphysical implications of the individuality thesis, which serves as an exemplar of scientifically informed metaphysics. (shrink)

I spell out and update the individuality thesis, that species are individuals, and not classes, sets, or kinds. I offer three complementary presentations of this thesis. First, as a way of resolving an inconsistent triad about natural kinds; second, as a phylogenetic systematics theoretical perspective; and, finally, as a novel recursive account of an evolved character. These approaches do different sorts of work, serving different interests. Presenting them together produces a taxonomy of the debates over the thesis, and isolates ways (...) it has been productive. This goes to the larger point of this paper: a defense of the individuality thesis in terms of its utility, and an update of it in light of recent theoretical developments and empirical work in biology. Biological lineages move through time, space, and each other. As they do, they diversify, diverge, and grade away from and into one another. One result of this is genealogical discordance; i.e., the lineages of a biological entity may have different histories. We see this on numerous levels, from microbial networks, to holobionts, to population-level lineages. This paper considers how genealogical discordance impacts our study of species. More specifically, I consider this in the context of three framing questions: (1) How, if (...) at all, does genealogical discordance challenge, modify, or revise how we conceive of species? (2) How has growing appreciation of genealogical discordance impacted scientific practice? Of systematics in particular? (3) How do lineages at different levels diverge and diversify? All told, genealogical discordance enriches and complicates our taxonomic ontology, as well as the practice of reconstructing phylogenies. This presents both challenges and opportunities for the study of divergence and diversification. (shrink)

Type specimens are used to designate species. What is the nature of the relation between a type specimen and the species it designates? If species names are rigid designators, and type specimens ostensively define species, then that relation is, at the very least, a close one. Levine :325–338, 2001) argues that the relationship of type specimen to a named species is one of necessity—and that this presents problems for the individuality thesis. Namely, it seems odd that a contingently selected specimen (...) should belong to a species of necessity. In considering Levine’s argument, LaPorte suggests that recognizing the distinction between de re and de dicto necessity resolves Levine’s worries. I reconsider the motivating question: does a type specimen belong of necessity to the species that it designates? In light of taxonomic cases and practice the answer is clear: definitively not. This is particularly clear in the case of re-designation of types by taxonomic decree. I explain how this helps reveal how taxonomists prioritize competing theoretical commitments, and offer a defense of the individuality thesis as applied to these particular cases. Research that involves the creation of animals with human-derived parts opens the door to potentially valuable scientific and therapeutic advances, yet invokes unsettling moral questions. Critics and champions alike stand to gain from clear identification and careful consideration of the strongest ethical objections to this research. A prevailing objection argues that crossing the human/nonhuman species boundary introduces inexorable moral confusion (IMC) that warrants a restriction to this research on precautionary grounds. Though this objection may capture the intuitions of many who (...) find this research unsettling, it relies on mistaken views of both biology and moral standing, ultimately distorting the morally relevant facts. We critically examine IMC, identify mistaken essentialist assumptions, and reframe ethical concerns. The upshot is a stronger line of objection that encourages a more inclusive and productive ethical discourse. (shrink)

Samir Okasha argues that clade selection is an incoherent concept, because the relation that constitutes clades is such that it renders parent-offspring (reproduction) relations between clades impossible. He reasons that since clades cannot reproduce, it is not coherent to speak of natural selection operating at the clade level. We argue, however, that when species-level lineages and clade-level lineages are treated consistently according to standard cladist commitments, clade reproduction is indeed possible and clade selection is coherent if certain conditions obtain. Despite (...) clade selection's logical coherence, however, we share some of Okasha's pessimism. Whether or not clades are a unit of selection is ultimately a question of empirical support and theoretical import. (shrink)

The papers included in this special issue were selected from a series of three interdisciplinary workshops titled Species in the Age of Discordance. Participants including philosophers, phylogeneticists, systematists, population geneticists, invasion biologists, historians, social scientists, botanists, herpetologists, ichthyologists, and microbiologists, among others, were asked to consider species in the context of discordance. The sense of “discordance” was left intentionally ambiguous in the call for abstracts, as our goal was to examine this question from many different perspectives, to seek out connections (...) across disciplines, to think about the different ways discordance surrounding species is conceived, and to ascertain how the varieties of discordance might inform each other. Clark and Fischer propose that people interpret social robots not as social agents, but as interactive depictions. Drawing on research focusing on how children selectively learn from social others, we argue that children do not view social robots as interactive toys but instead treat them as social learning partners and critical sources of information.

Thomas Pradeu’s The Limits of the Self provides a precise account of biological identity developed from the central concepts of immunology. Yet the central concepts most relevant to this task are themselves deemed inadequate, suffering from ambiguity and imprecision. Pradeu seeks to remedy this by proposing a new guiding theory for immunology, the continuity theory. From this, an account of biological identity is provided in terms of uniqueness and individuality, ultimately leading to a defense of the heterogeneous organism as expressing (...) the highest degree of individuality. Osiurak and Reynaud offer a unified cognitive approach to cumulative technological culture, arguing that it begins with non-social cognitive skills that allow humans to learn and develop new technical information. Drawing on research focusing on how children acquire knowledge through interactions others, we argue that social learning is essential for humans to acquire technical information.

The First Conference of the International Society for the Study of Time was held at the Mathematisches Forschungsinstitut at Oberwolfach in the Black Forest, Federal Republic of Germany from Sunday, 31 August to Saturday, 6 September, 1969. The origin of this conference and the formation of the Society goes back to a proposal due to J. T. Fraser that was discussed at a conference on "Interdisciplinary Perspectives of Time" held by the New York Academy of Sciences in January, 1966. It (...) was unanimously agreed than that an international society should be formed on an interdisciplinary basis with the object of stimulating interest in all problems concerning 'time and that this object could best be attained by means of conferences held at regular intervals. J. T. Fraser was elected Secretary, S. Watanabe Treasurer, and I was elected President. It was agreed, at my suggestion, that the organization of the first conference of the newly formed Society be left to a committee of these three officers, on the understanding that they would invite authorities on the role of time in the various special sciences and humanities to form an Advisory Board to assist them. One of the main difficulties in seeking support for an interdisciplinary conference is that most foundations confine their interest exclusively either to the sciences or to the humanities. (shrink)

Exploring whether clades can reproduce leads to new perspectives on general accounts of biological development and individuation. Here we apply James Griesemer's general account of reproduction to clades. Griesemer's account of reproduction includes a requirement for development, raising the question of whether clades may bemeaningfully said to develop. We offer two illustrative examples of what clade development might look like, though evaluating these examples proves difficult due to the paucity of general accounts of development. This difficulty, however, is instructive about (...) what a general account of development should look like and how it may usefully be applied to research problems (further suggesting a means for evaluating general accounts of development). Reproduction also requires individuation of parent and offspring. We argue that there is no special problem of individuating older and younger clades. The vagaries involved with determining when clades begin, mature, and end are precisely the same as those that arise when the same questions are asked of cells, organisms, or species. Though the question of clade reproduction and selection may still be open, the process of discovery presents new insights into old problems. (shrink)

The themes, problems and challenges of developmental systems theory as described in Cycles of Contingency are discussed. We argue in favor of a robust approach to philosophical and scientific problems of extended heredity and the integration of behavior, development, inheritance, and evolution. Problems with Sterelny's proposal to evaluate inheritance systems using his `Hoyle criteria' are discussed and critically evaluated. Additional support for a developmental systems perspective is sought in evolutionary studies of performance and behavior modulation of fitness.

İslâm’ın ilk dönemlerinden başlayarak âlimler neshin mahiyeti, delilleri ve Kur’an’da geçen emir ve nehiy ifadeleri yanında haber ifadelerinin neshin konusu olup olmayacağı meseleleri üzerinde yoğunlaşarak bir nesh teorisi meydana getirmişlerdir. Bu bağlamda şer’î hüküm içeren haber ifadelerinin emir ve nehiy manasında oldukları için metninin daha sonra gelen şer’î bir delille nesh edilmesi caiz görülmüştür. Haberin ifade ettiği şeye gelince; Allah’ın sıfatları ve kıyametin kopuşu gibi değişmesi mümkün olmayan şeylerden ise, yalana yol açacağı için, bunun nesh edilmesi caiz görülmemiştir. (...) Bu iki konuda âlimler ittifak etmişlerdir. Geçmişte olanları ve gelecekte olacak hâdiseleri bildiren haberin ifade ettiği şeyin neshin konusu olup olmayacağı konusunda ise ihtilafa düşmüşlerdir. A partir de acá, se ponen en liza dos vías para llegar a un mismo espacio de florecimiento; los bordes por los que cercamos el sentido profundo del ser. Para eso, tomamos el valor poético que emerge de la obra del poeta argentino Hugo Mujica. (...) Allí se encontrarán elementos suficientes de análisis filosófico, especialmente en la obra de Heidegger y Lévinas, para después, no sólo acompañar sino acontecer en la experiencia propia la interpretación posible a lo profundo de su poesía. El método será el hermenéutico existencial, centrando lo hermenéutico en la contextualización e interpretación de la obra escrita, y lo existencial en el momento de interpretar poemas. En torno al libro de Hannah Arendt Los orígenes del totalitarismo se buscan explicaciones a la lógica del Estado totalitario, es decir, su modo de operar y sus consecuencias en el ámbito de la libertad, del reconocimiento y del modo de vida que los sujetos pueden esperar en tal Estado. Se encuentra que el terror que se impone logra una deshumanización de los sujetos que, al haber perdido todo lo racional, se encuentran en el territorio de lo inconcebible.

Esta es la versión escrita de una entrevista realizada a Eugenio Bulygin, profesor emérito de Filosofía del Derecho (UBA), con respecto a quien toda presentación podría resultar o bien imcompleta o bien superflua. -/- Nuestra intención al realizar esta entrevista fue indagar acerca de las respuestas que dieron a esos interrogantes las personas que, en ese momento, ocuparon posiciones de toma de decisión en la Facultad de Derecho de la UBA. Fıkıh literatüründe sünnet önemli bir yere sahiptir. Çünkü fıkhın temeli Hz. Peygamber tarafından atılmış ve fıkhın gayesini en iyi bilen ve uygulayan kendisi olmuştur. Bu sebeple şer’î amelî konularda hüküm istinbatı için müctehid imamlar, Kur’an’dan sonra sünnete başvurmuşlardır. Bununla birlikte müctehid imamlar, Hz. Peygamber’den gelen rivayetlerin bazılarını kabul ve onlarla amel etmede görüş ayrılıkları yaşamışlardır. Görüş ayrılıklarının temelinde ise sünnetin ekseriyetini teşkil eden haber-i vâhid vardır. Çünkü haber-i vâhid yapısal açıdan yalan, yanlışlık ve vehm ihtimali bulundurması yanında doğruluğu (...) zan ile sabit olması sebebiyle özellikle Hanefî usûlcülerine göre bilgi ifade etmez. Bu yönüyle haberi vâhid, mütevâtir haber kadar kuvvetli ve bağlayıcı olmayıp zannî bir bilgi ifade eder. Bu doğrultuda haber-i vâhid, “bilgi gerektirmez, zan gerektirir” şeklinde ifade edilmiştir. Bu ifade bağlamında şöyle bir soru ortaya çıkmaktadır: Haber-i vâhid, bilgi ifade etmediği halde, onunla amel edilmesi mümkün müdür? Bu sorudan hareketle zan ifade eden haber-i vâhidin hücceti ve onunla amel edilmesinin mümkün olup olmadığını, mezheplerin haber-i vâhide yaklaşımlarının nasıl olduğunu ve bu durumun cenaze bahsine ilişkin hükümlere nasıl yansıdığını ortaya koymak amacıyla bu çalışma ele alınmıştır. Dolayısıyla bu çalışmanın konusu, haber-i vâhidin hücceti için mezheplerin ileri sürdüğü farklı şartlar ve bu şartların hükümlere -cenaze namazı özelinde- etkisi ile sınırlıdır. Yöntem olarak öncelikle kavramsal çerçevede haber-i vâhidi tanımlamak, bilgi değerini ortaya koymak ve mezheplerin onunla hücceti noktasında benimsedikleri şartları tespit etmek amacıyla ilgili mezheplerin usûl eserleri incelenmiştir. Daha sonra mezheplerin benimsediği bu usûlî yöntem, cenaze bahsindeki yerini belirlemek üzere ilgili mezheplerin fürû kitapları taranmıştır. Bu metottan hareketle mezheplerin usûlde benimsediği ilkenin fürû meselelerine nasıl yansıdığı, haber-î vâhidin zannî bilgi ifade etmesine rağmen onunla amel etmenin gerekçesi ve cenazeye ilişkin bazı hükümlerde mezheplerin farklı hüküm benimsemelerinin nedeni ortaya konulacaktır. Haber-i vâhidin delil değeri problemi, 2. (8.) yüzyıldan itibaren kelamcılar (:Mutezile), fıkıhçılar ve hadisçiler arasında tartışılan ve hakkında kayda değer bir literatür ortaya çıkan usûlî konuların başında gelmektedir. Şeybânî (ö. 189/805), Şâfiî (ö. 204/820), İsâ b. Ebân (ö. 221/836) ve Buhârî (ö. 256/870) gibi sünnî ekolün tanınmış fıkıh ve hadis alimlerinin haber-i vâhid lehine ortaya koydukları çalışmalar bu noktada oldukça etkili olmuştur. Bu etkinin bir sonucu olarak başlangıçta haber-i vâhidi toptancı bir yaklaşımla reddeden Mutezili isimler, yerini zamanla (...) Ebû Ali el-Cübbâî (ö. 303/916) gibi başka bir delille desteklenmesi şartıyla kabul eden alimlere bırakmıştır. Cübbâî, muhtemelen Kitâbü’l-ahbâr isimli günümüze ulaşmayan çalışmasında, hem tek kişinin haberi anlamındaki haber-i vâhidin hücciyet delillerini tenkit etmiş hem de çeşitli delillerle kendi kişisel görüşünü temellendirmeye çalışmıştır. Onun bu tenkit ve görüşleri, 4. (10.) yüzyılın önemli Hanefi fakih ve usulcüsü Cessâs (ö. 370/981) tarafından usul ilminin kurucu metinlerinden el Fusûl’de üstü kapalı bir şekilde nakledilmiş ve eleştirel bir değerlendirmeye tabi tutulmuştur. Araştırmamızda Cübbâî’nin, haber-i vâhidin delil değeri, kabul şartları konusundaki eleştiri ve görüşleri ile Cessâs’ın ona verdiği cevaplar ve karşı eleştirileri ele alınmıştır. (shrink)

According to Haber and Benham (2012), a sufficient condition for full moral consideration is that a creature bears a genealogical relation to the Homo sapiens lineage. Since part-humans do not bear such a relation, they are not due full moral consideration on that basis. Given this argument, my aim in this commentary is twofold. First, I want to challenge its soundness by showing that it is possible for part-humans to bear a genealogical relation to the H. sapiens lineage. Second, (...) Çocuk evliliği, tarih boyunca farklı toplumlarda bilinen ve uygulanan sosyal bir olgu olsa da son zamanlarda, modern duyarlılıkları giderek daha fazla rahatsız eden bir hal almıştır. Son iki asır öncesine kadar, Avrupa hukuki düşüncesinde çocuklar yargı önünde farklı bir muamele görmelerine imkan veren istisnai bir statüye sahip değildi. Diğer taraftan, İslam hukukunun çocuklara, özel bir hukuki statü kazandırma konusunda bazı öncü adımlar attığını söyleyebiliriz. Nitekim, en eski İslam hukuku kitaplarının bile, insanın fiziksel ve zihinsel gelişim aşamalarına ve her bir aşamada (...) ortaya çıkan hukuki hükümlere dair son derece teknik ayrıntılarla dolu olduğunu görebiliriz. Ancak çocuk hakları konusundaki bu erken farkındalığa rağmen, çocuk evliliği olgusu hem İslam toplumlarında hem de İslam hukukunda kendini gösterebilmiştir. Çünkü, İslam çocuk hukuku, ilk ortaya çıktığı dönemin kültürel şartlarından ciddi şekilde etkilenmiştir. Üstelik bu kültürel şartlar, İslam dünyası boyunca İslam çocuk hukukunun temel zemini olma işlevini sürdüre gelmiştir. Bu çalışma, alimlerin çocuk evliliğini delillendirmek üzere yapageldikleri bazı aşırı yorumları ortaya koymaya ve konuyla ilgili âyetleri metinsel bağlamıyla daha uyumlu bir şekilde okumaya çalışmaktadır.Özet: Her bağlam için geçerli olabilecek, standart bir çocuk tanımı yapmak göründüğünden daha güçtür. Bu nedenle çocuk araştırmaları sahasında çalışan akademisyenlerin, muhtelif sosyal disiplinler tarafından yapılacak herhangi bir çocuk tarifi konusunda memnuniyetsizlik içinde olması doğaldır. Diğer yandan, İslam hukukunda baştan beri ayrıntılı bir çocuk hukuku teorisi mevcuttur. İslam hukuk düşüncesinde, insanlar doğum ile yetişkinlik arasındaki gelişim döneminde üç aşamadan geçerler: Çocukluk (küçüklük), buluğ ve rüşt. Bütün fıkıh mezhepleri, insanın doğumu ile ergenliği arasındaki dönemde küçük çocuk sayılacağı kanaatindedirler. Bu çocukların mallarının en iyi şekilde idare edilebilmesi için yasal temsilcileri bulunmak zorundadır. Fakîhler çocuğun velisinin, özellikle de baba veya baba tarafından dedenin, velâyeti altındaki küçük çocuklar üzerinde mücbir bir yetkisi olduğu (velâyet-i mücbire) konusunda geniş bir fikir birliğine sahiptirler. Buna göre veliler, velâyetleri altında bulunan çocukları uygun gördükleri kişilerle evlendirme yetkisine de sahiptirler. Fakat zaman zaman beşik kertmesi olarak da anılan bu uygulama bir ön sözleşmeden ibarettir. Yani bu sözleşme doğrudan doğruya fiziksel boyutları da olan müşterek bir evlilik hayatını meşru kılmamaktadır. Çünkü cinsel hayatın ancak buluğdan sonra gerçekleşmesi ön görülmektedir. Modernite öncesi İslam tarihi boyunca, İbn Şubrume (ö. 144/761), Ebû Bekr el-Esamm (ö. 200/816) ve Osman el-Bettî (ö. 143/760) gibi bir kaç fakih dışında küçük çocukların evlenmesine kategorik olarak karşı çıkan kimselere pek rast gelinmemektedir.Hanefi mezhebinde, herhangi bir zihinsel özrü olmaksızın buluğa eren erkek ve kız çocuklar evlilik konusunda mücbir velâyetin kapsamı dışına çıkarlar. Bu, evlilik sözleşmelerini bizzat gerçekleştirebilecekleri anlamına gelmektedir. Fakat veli, uygunsuz bulduğu evliliğe karşı dava açarak bunu yargı yoluyla geçersiz kılma yoluna gidebilir. Diğer üç Sunnî mezhep ise erkek ve kız çocuklar arasında bir ayrım yapar: Buluğa eren erkek kendi evlilik akdini yapabilme hakkını elde ederken aynı durumdaki kız çocuklar velâyet altında kalmaya devam ederler. Şâfiʿî mezhebine göre, velâyeti gerekli kılan illet (bekaret) hâlâ geçerliliğini korumaktadır. Dolayısıyla veli, kızları evlendirme konusundaki icbâri yetkisini elinde tutmaya devam etmektedir. Bu durumda kızın rızasının alınması, akdin geçerliliği için şart olmaktan ziyade sadece nezaket gereğidir. Rüşte ulaşmak veya fizyolojik olgunlaşma sürecini tamamlamak ise İslam hukukunda evlilik için şart görülmemiştir.Modern zamanlara kadar geleneksel İslam hukukunun erken evlilik lehinde gösterdiği bu yaklaşımda herhangi bir değişiklik olmamıştır. 1917 yılında çıkan Hukuk-ı Aile Kararnamesi daha önce benzeri görülmemiş bir dizi düzenleme getirmiştir: İlk olarak, evlilik yaşı erkek için on sekiz kız için ise on yedi olarak belirlenmiştir. On sekiz yaşın altındaki erkeklerin hakimden evlenme izni alması; on yedi yaşından küçük kızların ise hem veli onayı hem de hakim iznine sahip olması zorunlu hale getirilmiştir. On iki yaşın altındaki erkekler ile dokuz yaşından küçük kızların ise asla evlendirilemeyeceği kararlaştırılmıştır.Mantıkî bağlam ve sentaktik yapı elverişli olmamasına rağmen fakihler çocuk evliliğini desteklemek üzere bazı Kur’ân âyetlerine (Nisâ 4/3-6, Nisâ 4/127, Talâk 65/4) referansta bulunmuşlardır. Makale içeriğinde detaylı şekilde açıklandığı üzere zorlama yorumlamalarda bulunmuşlardır. Bu makale, söz konusu âyetlere daha tutarlı bir yorum getirmeye çalışmaktadır. Aynı şekilde, Kur’an’ın çocuk evliliğini kolaylaştırıcı bir tavır içerisinde olmadığını, çocukların evlendirilebilmesi yönündeki yaklaşımların tarihsel ve kültürel şartlara bağlı olarak yapılan bazı zorlama yorumlara dayandığını ileri sürmektedir.Hz. ʿÂişe’nin Hz. Peygamber ile oldukça erken bir yaşta evlendiğine dair nakledilen rivâyet de konuyla ilgili olarak ileri sürülen başka bir argümandır. Bu rivâyetin sahih olduğuna inanılmaktadır. Buna rağmen ilginç bir şekilde bu rivâyet çok az fakih tarafından kullanılmıştır. Bunun sebebi, fakîhlerin Hz. Peygamberin mahremiyetinden bahsetmek istememeleri olabilir. Rivâyetin hücciyeti konusuna kuşkuya kapılmış olmaları da mümkündür. Söz konusu rivâyete daha yakından bakıldığında, ifadedeki menfi üslup hemen dikkat çekmektedir. Çünkü rivâyette Hz. ʿÂişe, Hz. Peygamberle evlendiği günü anlatırken sürekli olarak fizyolojik ve psikolojik açıdan olumsuz koşullardan bahsetmektedir. Nitekim Hz. ʿÂişe birden bire oynamakta olduğu salıncaktan alınmakta ve kendisinin de bilmediği bir yere doğru götürülmektedir. Rivâyet, sadece çocuk evliliğinin cevazını ortaya koymakla yetinmemekte, sanki aynı zamanda çocukların uygunsuz koşullardaki evlilik taleplerine bile itaatkar olmaları gerektiğini salık vermektedir. İçerik yanında teknik olarak bakıldığında bu rivâyet, haber-i vâhiddir. Çünkü rivâyet, sadece Hz. ʿÂişe tarafından bilinebilecek detayları içermektedir. Tarihî açıdan bir öneme sahip olmasına rağmen dinî hükümlere kanıt olma niteliğinden yoksundur. Çünkü bu rivâyette, râvi konuyla ilgili Hz. Peygamber’e ait resmi bir açıklamayı nakletmemekte; sadece kendi zaviyesinden maruz kaldığı bir durumdan bahsetmektedir. (shrink)

En "Legal Reasons, Sources and Gaps", Raz señala que las lagunas jurídicas existen sólo cuando el derecho habla con voz incierta o cuando habla con muchas voces, pero que no hay lagunas cuando el derecho guarda silencio. En este último caso habría reglas de clausura, analíticamente verdaderas, que impiden la ocurrencia de esas lagunas. Según Raz, si hay una laguna en un sistema jurídico, entonces no es verdadero ni falso que exista una razón concluyente para ejecutar cierta acción. Así, una (...) de las contribuciones más importantes de Raz a la solución del problema de las lagunas jurídicas es subrayar que el discurso jurídico no está completamente controlado por la bivalencia. Sin embargo, a menudo se sostiene que el rechazo de la bivalencia conduce a contradicciones. Si esta afirmación fuese verdadera, entonces la solución de Raz al problema de las lagunas jurídicas se vería seriamente amenazada. En este artículo mostramos, con ayuda de una herramienta analítica sofisticada, i.e., la lógica de la verdad de G.H. von Wright, que el rechazo de la bivalencia sólo nos compromete a aceptar la conclusión trivial de que puede haber proposiciones que no son verdaderas ni falsas. Por esta razón, el trabajo de Raz todavía puede ser considerado un buen punto de partida para analizar las relaciones entre normas, razonamiento práctico y lagunas jurídicas. Sin embargo, también mostramos que para admitir proposiciones que no son verdaderas ni falsas, las tesis de Raz deben ser reformuladas. De otra manera, la tesis de que no existen lagunas cuando el derecho guarda silencio no sería compatible con el rechazo de la bivalencia. /// In his paper "Legal Reasons, Sources and Gaps", Raz says that legal gaps only exist when law speaks with uncertain voice or when it speaks with many voices, but there are no gaps when law is silent. In this later case, rules of closure, which are analytically true, prevent from the occurrence of gaps. According to Raz, if there is a gap in a legal system, then both the claim that there is a conclusive legal reason to perform a certain action, and its negation are neither true nor false. Therefore, one of the Raz's most important contributions to the solution of the problem of legal gaps is to remark that legal discourse is not altogether governed by the principie of bivalence. However, philosophers often claim that the denial of bivalence leads to a logical inconsistency. If this claim were true, then Raz's solution to the problem of gaps would be seriously threatened. In this paper we show--with the aid of a sophisticated analytical tool, i.e., von Wright's truth-logic--that the rejection of bivalence only commits us to accept the trivial conclusion that propositions can lack truth-values. For this reason, Raz's paper can still be regarded as a good starting-point for analyzing the relationships between norms, practical reasoning and legal gaps. However, we also show that in order to admit propositions which are neither true nor false, Raz's theses must be reformulated. Otherwise, the claim that there is no gap when law is silent would not be compatible with the rejection of bivalence. (shrink)

İSNAD atıf sistemi ise Türkiye (...) merkezli olarak Antropoloji, Arkeoloji ve Sanat Tarihi, Coğrafya, Dil ve Edebiyat, Eğitim, Felsefe, Halkbilimi, Hukuk, İktisadi ve İdari Bilimler, İlahiyat, Psikoloji, Sanat, Sosyal Hizmetler, Sosyoloji ve Tarih gibi sosyal ve beşeri bilimler alanında görülen atıf ve kaynak gösterme gereksinimlerinin giderilmesi amacıyla geliştirilmiştir.İSNAD atıf sistemi; akademik bir yazının başlığının nasıl belirleneceği, özetinin hangi bilgileri içermesi gerektiği, anahtar kavramların nasıl seçileceği, başlıklandırma formatının nasıl olması gerektiği, içerdiği tablo ve şekillerin nasıl oluşturulacağı, çalışmada kullanılan Arapça, Farsça, İngilizce ve diğer eser adlarının ve müellif isimlerinin nasıl yazılacağı, tarih ve yüzyılların hangi şekilde gösterileceği, yayın etiği kapsamında nelere dikkat edilmesi gerektiği, istifade edilen kaynak eserden dolaylı veya doğrudan nasıl alıntı yapılacağı, atıf yapılan kaynakların metin içinde veya dipnotta nasıl yazılacağı ve kaynakçanın nasıl oluşturulacağı gibi akademik yazımla ilgili bilinmesi ve uygulanması gerekli tüm kuralları içermektedir.Sözlükte “dayanmak, yaslanmak, itimat etmek” manasındaki “sened” kökünden türeyen isnad, “temellendirmek, dayamak; sözü söyleyenine kadar ulaştırmak, bir sözün, bir rivayetin geliş yolunu haber vermek, ilk kaynağa kadar götürmek” anlamlarına gelmektedir. “Sözünün senedi nedir?” örneğinde olduğu gibi sözün kaynağını sorgulamak ve belirtmek için kullanılmaktadır. Bu anlamda isnad, akademik yazımda atıf veya alıntı yapılan kaynağı belirtmek için geliştirilen atıf sistemine, Türkiye merkezli yayın yapan ilahiyat alan dergilerinde görev üstlenen editörlerin çoğunluğunun (%70,4) kararı ile ad olarak seçilmiştir.İSNAD atıf sistemi, 2017-2018 yıllarında “İlahiyat Atıf Sistemi” olarak geliştirildi ve ilk versiyonu 12/03/2018 tarihinde matbu ve online olarak yayınlanarak ücretsiz olarak kullanıma sunuldu. Sistemin Türkiye’de ve Türk Cumhuriyetlerinde ilahiyat alan dergileri arasında ilgi görmesi ve ilahiyat alanı dışında da kullanımına dair talepler gelmesi üzerine İSNAD’ın ikinci versiyonu, tüm sosyal bilimler alanında kullanılabilecek şekilde geliştirildi ve Eylül 2018 itibari ile hizmete sunuldu. Yaygın atıf biçimlerinden APA, Amerika Psikoloji Derneği (American Psychology Association) ve Chicago ise Modern Diller Derneği (Modern Languages Association) tarafından geliştirilerek satışa sunulmuştur.İSNAD; Türkiye merkezli olarak geliştirilen, kullanıma sunulduğu 12/03/2018 tarihinden kısa bir süre sonra hakemli akademik dergi ve kitap yayıncıları ile Fakülte Dekanlıkları (mezuniyet tezlerinin yazımında) ve Sosyal Bilimler Enstitüsü Müdürlüklerince (Yüksek Lisans ve doktora tezlerinin yazımında) kullanımı benimsenen, Web of Science / Clarivate Analytics, TÜBİTAK TR Dizin ve TÜBİTAK DergiPark gibi akademik yayıncılıkla ilgili indeks ve dergi platformlarınca kaynak gösterme biçimlerinden biri olarak sistem entegrasyonu yapılan, Zotero, Mendeley ve EndNote gibi dünya çapında kullanılan kütüphane ve referans düzenleme yazılımlarına uygun şablonları hazırlanan ve ücretsiz olarak kullanıma sunulan ilk ve tek yerli-milli kaynak gösterme sistemidir ve bu açıdan oldukça önem arz etmektedir. Türkçe’nin bir bilim dili haline gelmesi hedefleniyorsa, bu hedefe ulaşmada, Türkçe olarak hazırlanan bir bilimsel yazım ve kaynak gösterme sisteminin bulunması da bir zorunluluktur. Ortaöğretim ve üniversite öğrencilerinin Türkçe olarak hazırlanan ve ücretsiz olarak kullanıma sunulan İSNAD atıf sistemini öğrenmeleri ve kullanmaları, aslı İngilizce olan ve satın alma imkanı da elde edemeyecekleri sistemleri öğrenmelerine kıyasla daha elverişlidir ve kolaydır. Türkçe konuşan ülkelerin bilim insanlarının bildiri, makale, kitap, proje ve benzeri bilimsel çalışmalarını İSNAD atıf sistemini kullanarak hazırlamaları, Türkçenin ortak bir bilim dili olarak güçlenmesine katkı sağlayacaktır. El artículo propone una lectura de Los orígenes del totalitarismo (1951) de H. Arendt que entiende esta obra como análisis de las causas que condujeron a la crisis y decadencia del Estado-nación moderno y propiciaron el experimento más destructivo de la condición política del hombre, el fenómeno totalitario. Comenzaremos señalando las razones de la displicencia de Arendt hacia las reglas del método sociológico, al considerar que sólo las acciones humanas pueden iluminar retrospectivamente cuáles son los elementos que han cristalizado en (...) los acontecimientos históricos. En segundo lugar, nos detendremos en la incompatibilidad que Arendt encuentra entre poder político y enriquecimiento económico, de la mano de la crítica que realiza del Leviatán de Hobbes, por haber proporcionado una legitimación teórica a las necesidades de una clase en ascenso, la burguesía. El imperialismo sería, así, la consecuencia lógica del olvido del principio que ordena a los hombres volver la tierra un lugar habitable, introduciendo en ella un sistema de mediaciones legales. Finalmente, nos ocuparemos de la crítica que Arendt dirige a los derechos humanos, estrechamente ligada a la destinada al nacionalismo latente en toda forma estatal, que reduce drásticamente su contenido a la exigencia de pertenecer a una efectiva comunidad política, explorando a este respecto las posibilidades de un diálogo con la Doctrina del derecho de Kant, que también hace de la formación de una unión civil una condición fundamental para la defensa efectiva de los derechos del hombre.
